Contributor terms and conditions

1. Introduction

This section contains the general legal Contributor Terms and Conditions, with additional terms and conditions on the Legal page.

Your use of the Volunteer area of the Website to submit Items means you accept and agree to comply with these terms and conditions as at the date of your first use of this Website and if you use the Website on behalf of your organisation, your organisation shall also be bound. Additionally, you will need to confirm that you have, where necessary, the permission to upload your Item(s) (as defined in clause 2 below) to the RNIB Bookshare UK education collection site.

2. Definitions

An "Accessible Copy" is a version which provides for an individual with a print disability improved access to the work. An Accessible Copy may include facilities for navigating around the version of the copyright work, so it covers hard and soft copies - such as braille, audio, e-text, large print, etc.

"Contributor" is a user who submits resources to the Website.

"Modify" refers to making minor amendments to the transcription of an Item for the purposes of creating or improving an Accessible Copy.

"Published Materials" refers to texts, images, worksheets or exam materials that have an ISBN number.

"Resources" refers to Published Materials and / or Unpublished Materials.

"Unpublished Materials" refers to texts, images, worksheets or exam materials that do not have an ISBN number.

3. Legal ownership of materials and permissions for hosting on RNIB Bookshare UK education collection 

3.1. Published Materials

As a Contributor of Published Materials you must either:

  • meet the requirements set out in the The Copyright and Related Rights (Marrakesh Treaty etc.) (Amendment) Regulations 2018 , 
  • have the rights to assign permission for the Item, and want to host on RNIB Bookshare  UK education collection; or
  • have permission from the publisher, who is authorised to give appropriate consents for how the materials may be used on RNIB Bookshare UK education collection
  • out of copyright in the UK.

3.2. Unpublished Materials

As a Contributor of Unpublished Materials you must either:

4.1 In consideration of this website displaying and advising you on your content you agree by uploading your content to give RNIB Bookshare non-exclusive licence of that content. This means that you agree that UK education collection can use, Modify, reproduce, and distribute such content for the benefit of individuals with a print disability. Subject to clause 4.2 below, this licence allows UK education collection world wide, royalty free, perpetual and irrevocable use where you upload Unpublished Materials.

4.2 Where the Contributor continues to retain all ownership rights in their content for Unpublished Materials they continue to retain intellectual property under the terms of the non-exclusive licence.

4.3 RNIB Bookshare UK education collection Contributors uploading resources to the RNIB Bookshare UK education collection website confirm that they have all rights and permissions required to do so and will enable RNIB Bookshare UK education collection to grant the rights specified in UK education collection's Terms and Conditions.

4.4 If you are entering into this agreement on behalf of your employer or other entity, you agree that you have the full right and authority to do so. In the event that you do not have such authority, you agree that you will be personally liable to RNIB Bookshare for any breaches of the terms of this agreement.

4.5 Where information is provided or compiled by a Contributor, they should endeavour to ensure that it is the most complete and accurate information available, RNIB Bookshare UK education collection cannot take responsibility for any inaccuracies, omissions or errors attributable to the author of such materials.

4.6 The Contributor asserts that content uploaded onto RNIB Bookshare UK education collection, is not illegal or infringes the rights of any other person(s), organisations or other legal entity.

4.7 The Contributor is responsible for identifying any content of a potentially offensive nature during the upload process.

4.8 The Contributor agrees that the files they provide to RNIB Bookshare UK education collection will be made available to users who may download, reproduce and Modify the content. For Unpublished materials where 'substantial changes' are made to the Item the editing user may also become a Contributor for the Item should it be re-uploaded.

4.9 The Contributor agrees to the indefinite hosting of an Item on RNIB Bookshare UK education collection.

5. RNIB Bookshare UK education collection's rights and obligations

5.1 RNIB Bookshare UK education collection is not under any obligation to display or make available an Item. RNIB Bookshare UK education collection reserves the right to remove an Item at any time for any reason.

5.2 RNIB Bookshare has permission to Modify materials and will do so where appropriate. 

5.3 We will credit the Contributor and where possible organisation with their Item contribution to the site. 

5.4 We will make every effort to review each Items suitability through RNIB Bookshare UK education collection's validation process. 

5.5 RNIB Bookshare UK education collection will record information on all Items downloaded from the service as a measure to protect the Items copyright.

5.6 RNIB Bookshare UK education collection will protect Items with watermarks to identify the hosting source, i.e. RNIB Bookshare UK education collection and protect their integrity and may insert user identifiable information.

5.7 RNIB Bookshare UK education collection may produce uploaded content in various file formats to be hosted and displayed on the site, and to be provided in other downloadable formats.

5.8 RNIB Bookshare UK education collection will provide guidance for uploading content to the site.

5.9 Where advised by the Contributor that content provided may be potentially offensive, RNIB Bookshare UK education collection will endeavour to advise users.

6. Commercial/non profit use

6.1 RNIB Bookshare UK education collection has been designed (i) to facilitate access for users who are not able to use standard print materials and visual images, requiring an Accessible Copy of these Items and (ii) to support the sharing of professional resources for teaching children with sight loss. Any use outside of these purposes (including but not limited to Commercial Use and Non Profit Use as defined in clauses 6.2 and 6.3) is not permitted.

6.2 Types of commercial use include (but not exclusively):

a. promoting an organisation, project or product;

b. using Items for which the user was funded to provide; and / or

c. Items for use in a publication that is for sale. 

(“Commercial Use”)

6.3 It is not permitted to:

a. use any Item in any way for organisational and/or financial benefit or gain/perceived gain;

b. use any Item (in whole or in part) as a trademark, service mark, logo, or other indication of origin, or to otherwise endorse or imply the endorsement of any goods and/or services;

c. use or display an Item in such a manner that gives the impression that the Item was created by you or a person other than the copyright holder of that Item;

d. create derivative products (e.g. posters) unless with the express permission of RNIB Bookshare ; and / or

e. RNIB Bookshare refuses all responsibility for any derivative products produced by an unscrupulous user. 

(“Non Profit Use”)

6.4 Content may only be used for Commercial Uses and / or Not for Profit Use with express and specific permission from RNIB Bookshare UK education collection. To apply for permission contact us at Bookshare@rnib.org.uk

7.1 Posting personal information on our Website means your information is publicly accessible. We strongly recommend that you avoid disclosing personal information that could be used to identify you (such as name, age, address, or name of employer).
